Privacy Policy 


GDPR
The General Data Protection Regulation (GDPR) was brought into effect on March 25th of May 2018. It is a Data Privacy Law and stipulates how consumer data should be collected, used and protected. It also clarifies what the individuals rights are concerning their own personal data.
The term, “images” is used to cover all works furnished by the Photographer, be them photographs, prints, USBs, digital copies or any other type of physical or electronic material. Seona McLean Photography takes your privacy and the handling of your data extremely seriously, in order to comply with GDPR there may be times when you will be asked to specifically opt in to receiving communication from us. 

What information is stored and how.
When purchasing images from my online gallery I will collect details such as your name, email address and any other necessary contact details, purely in the interest of processing and sending your order electronically.
I do not store payment information (such as credit/debit card details) unless provided by you for the purpose of processing an order - these details are then destroyed once the order has been processed.
Any data collected such as your name, email address and mailing address are used solely in the provision of photographic services, they are stored in a secure database and never shared with third parties.
In order to create and deliver photographic services and to deliver the comprehensive work seen in my portfolio, it is also necessary that I store images of the event participants likeness, as well as those of any animals or property which may appear in said images, as both jpg and RAW files on secure storage. These are stored separately from your full names and other data and the two files are never associated. 

Social Media and Promotional
I may display any photographs to promote Seona McLean Photography on my website, on social media, on photography related websites, in exhibitions, in advertising, brochures, magazine articles and other such materials, provided the images used are used lawfully and without damage to Seona McLean Photography ́s Clients. The rights of the people captured in these photographs are protected by Seona McLean Photography ́s detailed in this Privacy Policy. 

Seona McLean Photography retains the full copyright of any photographs produced. Seona McLean Photography retains the right to use images taken under her copyright as promotional material unless there is a good reason to protect a given individual's personal data. 

Events
Guests at events, including Horse Shows, appear in photos taken by Seona McLean Photography as a part of the visual recording of the events in the photos. Guests captured in photos do so as part of the event and their rights are protected by Seona McLean Photography as detailed in this Privacy Policy. 
In terms of GDPR compliance, event guests and show-goers are photographed within the parameters of GDPR legislation on the basis of `legitimate interests`. The taking of photographs of guests/participants when viewed as a form of processing personal data is necessary for the legitimate interests of Seona McLean Photography as a photography business, unless there is good reason to protect an individual's personal data which overrides those legitimate interests. By attending the event you automatically OPT IN to have your image recorded. 

Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all attending an event is infeasible to do. Event organisers are therefore requested to direct their guest to read this privacy policy in advance of the event and to advise them to contact Seona McLean Photography in advance with any concerns around the processing of their personal data, namely being photographed. 

Parties who do not wish to be photographed are also able to approach me at events and make me aware of such, and their request to be excluded from imagery will be honoured. 

How long will your information be kept?
I will hold your name, contact details and purchase history for up to 7 years from your last transaction with me, this is part of my financial records as it is a legal requirement to do so. If after 7 years I have not had contact with you, your records that identify you will be destroyed. 

Your right to access
You are able to request, on demand, all data that Seona McLean Photography, as a business, holds on you. This will be provided as an electronic report within 28 days of the request. 

Your right to be forgotten
You have the right to withdraw your consent to have your data stored at any time. If you choose to do so, please contact Seona McLean Photography stating so. Anyone photographed by Seona McLean Photography, whether past or current, may withdraw consent for a photograph in which they appear to be displayed online. The process for this is to email specifying the photo in question. After the request has been made, Seona McLean Photography will take the necessary steps to remove the image.
