Terms and Conditions

The following document details the terms set out by Seona Mclean of Seona Mclean Photography (hence referred to as “the Photographer''), and those making use of her photographic services (hence known as “the Client”). The term “images” is used to cover all works furnished by the Photographer, be them photographs, USB´s, digital copies, or other types of physical or electronic material.

The entire copyright and intellectual property rights of any images will remain that of the Photographer´s at all times throughout the world and regardless of medium. Copyright may be partially shared with a Client to allow the Client to print, display or distribute images. Details of such allowances vary and will be detailed in a Copyright Release Contract, and copyright will always remain with the Photographer. This is in accordance with the Copyright, Designs and Patents Act 1988. The act of screenshotting is a direct infringement of copyright law. Anyone caught screenshotting will be invoiced. A continuation of this act will result in The Photographer no longer photographing these people.

Right to Credit

The Photographer asserts their moral right to be identified as the author of her work and the right to be credited in accordance with Sections 77-79 0f the Copyright, Designs and Patents Act 1988. The Client must make all the efforts to ensure that the Photographer's name is included with the published reproductions of images.

Use

Images are to be used as agreed at the time of purchase or consultation. The licence to use the image is limited to the use and period of time specified. The images may not be used in any other form without the Photographers express permission. The Photographer must be consulted and an agreement made before the images are used for any other purposes.

EDITING AND MANIPULATION of the images is strongly discouraged and should contractually only occur with the permission of the Photographer.

“Web Digitals”, (also referred to as “Social Media Digitals”) are sized for and permitted to be used online and on social media platforms only. They may NOT be printed as this would be seen as a breach of the agreed usage and copyright.

“Full Res Digitals” (also known as “Full Resolution Digitals” or “Printing Digitals”) are permitted to be used for printing to any size, on any medium, and as many times as the Client desires. Full Res Digitals come with a copyright release authorising the Client to print said image as they see fit. The Client must still, however, seek permission before the image is published for profit or reward, such as entering a competition or publishing in a magazine.

As the main copyright holder of all images, the Photographer maintains the right to use images as she sees fit, such as to advertise on social media, etc. The only exception to this is if the Client makes the Photographer aware that they do not wish for the images of themselves or a third party to be visible online, in which case the Photographer shall keep the images private.

Client Confidentiality

The Photographer will keep all material and/or information communicated to her confidential and will not disclose said information to any third parties lest it be reasonably necessary to enable the Photographer to carry out her obligations in relation to work.

Archiving of Images

All images will be available on the appointed online gallery for a minimum of one month after the upload date. After this period of time they will be stored and archived by the Photographer for one year. Every effort will be made to store the images for as long as possible after this period, however after this set time the Photographer can not be held liable for any archived images which may be lost, stolen or damaged.
